LISN KIDS offers an audio streaming service that allows our users to access children’s entertainment content (the “LISN KIDS Content”) on certain iOS and Android compatible devices.
These Terms of Use govern your use of our service. As used herein, the terms “LISN KIDS service”, "LISN KIDS App“, "our service,” "the App" or “the service” refer to the service provided by LISN KIDS for discovering and accessing LISN KIDS Content, including all features, recommendations, user interfaces, as well as all content and software associated with our service. “You” refers to the user who has created a LISN KIDS account and is being charged subscription fees through the chosen Payment Method if an unlimited streaming plan has been subscribed.
1. Subscription
1.1. Your LISN KIDS subscription will continue until terminated. To use the LISN KIDS service, you must have Internet access and a LISN KIDS compatible device, and provide us with one or more Payment Methods.
“Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party.
1.2. We may offer a variety of subscription plans, including special promotional plans or subscriptions offered by third parties in conjunction with the provision of their own products and services. Some subscription plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications available to you. Specific details for your LISN KIDS subscription can be found by visiting the LISN KIDS mobile app and clicking on the “Account” link.
2. Billing and Cancellation
2.1. Billing Cycle
The subscription fee for the LISN KIDS service will be charged to your Payment Method on the specific payment date indicated on your Google Play subscription page or Apple Subscription page. The length of your billing cycle will depend on the type of subscription that you choose when you signed up for the service. In some cases, your payment date may change, for example, if your Payment Method has not successfully settled, or if your paid subscription began on a day not contained in a given month.
2.2. Payment Methods
You may use the native payment form from Google Play Store on Android or App Store on iOS devices.
To use the LISN KIDS service, you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for your subscription fees. You remain responsible for any uncollected amounts.
2.3. Updating Your Payment Methods
You can update your Payment Methods by going to the Google Play subscription page or Apple Subscription Page.
2.4. Cancellation
You can cancel your LISN KIDS subscription at any time, and you will continue to have access to the service through the end of your billing period. Payments are non-refundable and we do not provide refunds or credits for any partial subscription periods or unlistened LISN KIDS content.
3. LISN KIDS Service
3.1. The LISN KIDS service and any content accessed through the service are for your personal and non-commercial use only and may not be shared with individuals beyond your household. We grant you a limited, non-exclusive, non-transferable, license to access the LISN KIDS service and listen to LISN KIDS content. Except for the foregoing, no right, title or interest shall be transferred to you.
3.2. You agree not to use the service for public performances.
3.3. The LISN KIDS service, including the content library, is regularly updated.
3.4. You must be at least 18 years of age to subscribe to the LISN KIDS service. Minors may only use the service under the supervision of an adult.
3.5. The quality of the display of the LISN KIDS content may vary from device to device, and may be affected by a variety of factors, such as your location, bandwidth availability and/or the speed of your Internet connection.
4. Passwords and Account Access
4.1. The member who created the LISN KIDS account and whose Payment Method is charged is responsible for any activity that occurs through the LISN KIDS account. To maintain control over the account and prevent anyone from accessing it (which includes information regarding viewing history for the account), the account owner should maintain control over the LISN KIDS compatible devices that are used to access the service and not reveal the password or details of the Payment Method associated with the account to anyone.
5. Miscellaneous
5.1. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of Canada.
5.2. Unsolicited Materials
LISN KIDS does not accept unsolicited materials or ideas for LISN KIDS content and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to LISN KIDS.

5.4. Changes to Terms of Use
LISN KIDS may, from time to time, change these Terms of Use. We will notify paid users only by email if new Terms of Use apply.
5.5. Electronic Communications
We will send you information relating to your account (e.g., payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.
6. App Store License
LISN KIDS app is made available through the App Store and is licensed, not sold, to you. This license to the App is subject to your prior acceptance of either this Licensed Application End User License Agreement (“Standard EULA”).
